Welcome to NCTSA (Negotiation & Crisis Tactical Solutions Agency). These Terms & Conditions constitute a legal agreement between you (“the Client” or “you”) and NCTSA (“we,” “us,” or “the Agency”). By accessing and using our services, you agree to abide by these terms and conditions. If you do not agree with these terms, you must not use our services.

Definitions

  • “Services” refers to the crisis negotiation, consultation, and resolution services provided by NCTSA as described on our website or in engagement letters.
  • “Client” refers to any individual or entity who engages NCTSA for services.
  • “Engagement Letter” refers to the formal agreement signed by the Client and NCTSA detailing the scope of services, retainer fees, and other terms specific to the engagement.
  • “Retainer Deposit” refers to the minimum upfront deposit required before direct intervention begins, as agreed upon in the Engagement Letter.
 

Services Provided
NCTSA provides specialized crisis negotiation and tactical solutions, including but not limited to:

  • Assessment of crisis situations (remote and on-site)
  • Resolution strategies and negotiation services
  • Crisis management and tactical advice
  • Consulting for high-stakes cases requiring immediate attention

Services are provided on a case-by-case basis, and an Engagement Letter must be signed before proceeding. Our services are tailored to clients who meet the specific criteria for engagement, including covering all travel and operational expenses upfront.

Payment & Refund Policy

  1. Retainer Deposit: All clients must pay a retainer deposit before direct intervention begins. The retainer amount will be outlined in the Engagement Letter, with a minimum of $10,000, depending on the case.
  2. Payment for Expenses: The Client is responsible for covering all travel, lodging, and operational expenses, including but not limited to airfare, accommodation, and any other logistical costs required for the resolution process.
  3. Success Fee: If assets or money are involved in the case, a success fee (ranging from 10-30% of the final outcome) will be agreed upon in the Engagement Letter.
  4. Refund Policy: Given the nature of our services, we do not offer refunds. The retainer deposit and any payments made are non-refundable once the engagement has begun, as the work involved is highly specialized and customized to the client’s needs.
 

User Responsibilities

  1. Truthful Information: You must provide accurate, truthful, and complete information during the initial screening process and throughout the engagement.
  2. Cooperation: You agree to cooperate fully with NCTSA in the resolution process, including providing access to relevant data, personnel, or any other resources that may be needed.
  3. Timely Payment: You agree to make payments for the retainer, expenses, and success fees as outlined in the Engagement Letter promptly and as agreed.
 

Limitation of Liability
NCTSA will not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use or inability to use our services. Our liability is limited to the amount paid by you for the services rendered in the specific engagement. We do not guarantee specific outcomes, and any action taken by NCTSA is based on our professional judgment and the unique circumstances of each case.

Dispute Resolution
Any disputes arising from this agreement shall first be resolved through amicable negotiation. If a resolution cannot be reached, the dispute will be resolved through arbitration in accordance with the rules of the jurisdiction in which NCTSA operates. The decision of the arbitrator shall be final and binding.

Amendments & Updates
NCTSA reserves the right to amend or update these Terms & Conditions at any time. Any changes will be communicated to clients through the website or via email. The most current version of the Terms & Conditions will be available on our website.
